Conflicting judgments: Six chief judges appear before NJC today

Barring any last-minute change in planning, the six chief judges summoned by the Chief Justice of Nigeria, Justice Tanko Muhammad, over conflicting court decisions that emanated from their jurisdictions will on Thursday (today) appear before the disciplinary committee of the National Judicial Council.

The chief judges summoned are those of Rivers, Kebbi, Cross River, Anambra, Jigawa and Imo states.

A source close to the NJC who did not want his name in print confirmed the development to our correspondent on Wednesday.

The source said the purpose of the meeting was to investigate the circumstances relating to the conflicting decisions.

He said, “There will be a meeting tomorrow (Thursday). They are to appear before the NJC disciplinary committee tomorrow.

“The committee is a fact-finding committee, a standing committee in the NJC that they will meet with.

“The committee members will ask them questions. They will find out from them why they allow such to happen in their states.

“Eventually, at another larger committee, they will submit the report and findings to the CJN.”

The source said the idea behind the CJN’s summon was not for the chief judges to meet him.

“The CJN cannot be part of investigation and still be part of decision making,” he explained.

UGAMATV had earlier reported that the CJN summoned the chief judges of six states over conflicting decisions given by courts of coordinate jurisdiction.

Three conflicting court decisions from courts of coordinate jurisdiction had emerged over the leadership tussle rocking the Peoples Democratic Party.

On August 24, a High Court in Rivers State made an interim injunction restraining Uche Secondus from parading himself as the National Chairman of the PDP.

On August 26, Justice Nusirat Umar of the Kebbi State High Court made an interim order returning Secondus to his position as the National Chairman.

Following the Kebbi court’s decision, a High Court sitting in Cross Rivers State made an interim order on August 27, restraining Secondus from resuming as the PDP Chairman.

Similarly, the courts in Jigawa, Anambra, and Imo States had also given conflicting decisions regarding the governorship candidature of the All Progressives Grand Alliance for the Anambra State election billed for November 6, 2021.

On July 16, the Independent National Electoral Commission had listed Chukwuma Umeoji as the candidate of APGA for the election in the state.

The listing of Umeoji was based on a court order of June 28 by a High Court in Jigawa.

Another High Court sitting in Anambra on July 18 had ordered INEC to include the name of Charles Soludo as APGA candidate for the election.

Following that, the High Court in Imo State declared Umeoji as the APGA candidate for the election.
