Lawyer accuses DSS of detaining client for 126 days

A lawyer, P. D. Pius, has alleged that the Department of State Services detained his client, the National President of the Youth Wing of Mumuye Cultural Development Association, Danladi Hassan, for 126 days without charging him to court.

Pius stated this in court in a bid to move his ex parte application before the Federal High Court, Abuja, on Thursday.

In his motion, he prayed the court to compel the DSS to produce his client in court and grant him unconditional release.

“The applicant who is presumed innocent is entitled to bail as a matter of course, having not been charged with any offence since his arrest on May 6, 2021 in his office at the Mumuye House, Mile 6, Jalingo, Taraba State, and his subsequent detention by the respondent’s officers till date,” the lawyer said.

He therefore prayed for an “order of the honourable court directing the respondent to produce the applicant in court immediately and show cause why the applicant should not be released unconditionally having been arrested on or about May 6, 2021 and detained at the pleasure of the respondents without any complaint or charge preferred against the applicant or any valid order of court.”

Pius also informed the court that he had an application for bail before the court.

Justice Egwuatu, the vacation judge, directed that the lawyer should notify the DSS of the application.

He also ruled that the case file would be sent back to the registry for onward reassignment since the court’s vacation was drawing to an end.
