FCCPC Summons Air Peace Over Alleged Non-Refunds and Consumer Rights Violations

The Federal Competition and Consumer Protection Commission (FCCPC) has summoned Air Peace Limited following widespread complaints from passengers alleging non-refund of ticket fares, even when the airline cancelled scheduled flights.

In an official notice dated June 13, 2025, the Commission directed the airline’s management to appear at its Abuja headquarters on Monday, June 23, 2025. The summons follows growing public outrage and accusations of breaches of consumer protection laws.

According to a statement issued by the FCCPC’s Director of Corporate Affairs, Ondaje Ijagwu, Air Peace’s actions may violate Sections 130(1)(a), 130(1)(b), and 130(2)(b) of the Federal Competition and Consumer Protection Act 2018. These sections entitle consumers to prompt refunds when services like bookings or reservations are not fulfilled due to the provider’s fault.

Ijagwu stated that under Sections 32 and 33 of the Act, the airline is required to present detailed documentation, including a 12-month log of refund complaints, records of all processed refunds, a list of cancelled flights within the same timeframe, and efforts made to reduce the impact on affected passengers.

He emphasized that Section 33(3) mandates strict compliance, warning that failure to comply may result in penalties, including fines or imprisonment.

Although the statement did not reference it, the summons comes shortly after a high-profile controversy involving Senator Adams Oshiomhole and Air Peace. The senator accused the airline of racketeering after allegedly missing a flight despite arriving on time. He claimed that several passengers were forced to pay an extra N109,100 to be rescheduled for a later flight, while the airline countered that Oshiomhole had arrived late.
